1. Who we are and how these Terms work
This website is operated by ANAS Crystalcare B.V. (“ANAS Crystalcare”, “we”, “us”, “our”). By accessing our website or buying our products, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the site.
We may update these Terms from time to time. The updated version applies from the date above. Your continued use of the site means you accept the changes.
Platform: Our store is hosted on Shopify. They provide the e-commerce platform that allows us to sell our products and services to you.
2. Who may use the site
By using the site you confirm you are (a) at least the age of majority in your country, or (b) using the site with the consent and supervision of a parent or legal guardian for a minor dependent. You must not use the site for any unlawful purpose.
3. Account, security and acceptable use
You are responsible for keeping your account credentials confidential and for all activity under your account. Do not misuse the site (no scraping, malware, spam, infringement, or attempts to bypass security). We may refuse service, suspend or terminate accounts at our reasonable discretion.
4. Products, pricing and availability
All products, descriptions, and prices may change at any time without notice. We may limit quantities, refuse or cancel orders (e.g., suspected fraud, stock errors). Colours and images are displayed as accurately as possible but may vary by device.
Taxes and pricing

Consumers (B2C): Prices shown include or exclude VAT as indicated at checkout and will include any applicable VAT based on your shipping destination.

Business customers (B2B): Prices are typically shown excluding VAT. For EU B2B customers with a valid VAT number, reverse charge may apply. For non-EU exports, 0% VAT may apply. You are responsible for any import duties, taxes, and customs clearance in your country.
5. Orders and contract formation
Your order is an offer to buy. We accept only when we send an order confirmation or dispatch the products. If we cannot accept your order, we will refund any payment received.
6. Payment
We accept the payment methods shown at checkout. Payment is due at order confirmation unless we agree otherwise in writing.
7. Shipping, delivery and risk
We ship to the destinations indicated at checkout. Delivery dates are estimates.

Consumers (B2C): Risk passes to you when the goods are delivered to you or a person you designate.

Business customers (B2B): Unless otherwise agreed in writing, risk passes when we hand the goods to the carrier at our warehouse (Incoterms: typically FCA Seller’s warehouse).
You must provide a correct and complete delivery address and be available to receive the parcel.
8. Retention of title (B2B)
For business customers, title to the goods remains with ANAS Crystalcare until full payment of all amounts due for those goods is received. You must not pledge or encumber goods under retention of title.
9. Right of withdrawal and returns
Consumers (B2C)
You have a 14-day right of withdrawal from delivery without giving any reason, except for products that are:

sealed and not suitable for return due to health protection or hygiene reasons once unsealed;

custom-made or clearly personalized items;
-
items that by nature cannot be returned.
To exercise the right, follow the instructions in our Returns Policy and return the products unused (and where applicable, sealed) within 14 days after notifying us. You bear the return shipping costs unless we state otherwise. We will refund payments (including standard outbound shipping) using your original payment method, subject to lawful deductions for diminished value from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Business customers (B2B)
Unless agreed otherwise in writing, no right of withdrawal applies to B2B purchases. Any return must be pre-authorized by us.
10. Non-conformity, warranty and inspection
Please inspect deliveries upon receipt.

Consumers (B2C): You have statutory rights regarding non-conforming goods under applicable consumer law.

Business customers (B2B): You must notify us in writing of any visible defects or shortages within 5 business days of delivery and of hidden defects within a reasonable time after discovery. Our liability for non-conforming goods is, at our option, limited to repair, replacement, or refund of the purchase price of the affected goods.
11. Optional tools and third-party links
We may provide access to third-party tools “as is” without warranties. Third-party links and resources are not under our control; we are not responsible for their content, policies, or actions. Review their terms before using their services.
12. User submissions (reviews, comments, ideas)
If you submit reviews, comments, photos, ideas or other content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, publish and display such content for our business (including marketing), in any media, without obligation to compensate you. Do not submit unlawful, infringing, or harmful content. We may monitor, edit, or remove content at our discretion.
13. Intellectual property
All content on the site (text, images, graphics, logos, product names, designs) is owned by or licensed to ANAS Crystalcare and is protected by IP laws. You may not reproduce or exploit content without our prior written consent.
14. Privacy and cookies
Your personal data is processed in line with our Privacy Policy and Cookie Policy, which form part of these Terms.
15. Limitation of liability
Nothing in these Terms limits or excludes liability where it would be unlawful to do so (including liability for death or personal injury caused by negligence, or for intent or gross negligence under Dutch law).
To the fullest extent permitted by law:

we provide the site and services “as is” and “as available”;

we exclude all implied warranties; and
-
we are not liable for any indirect, incidental, special or consequential loss, loss of profits, revenue, data, or business.
For B2B customers, and except for the carve-outs above, our total aggregate liability arising out of or in connection with any order is limited to the amount you paid for the products giving rise to the claim.
16. Force majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control (e.g., natural disasters, strikes, wars, epidemics, government actions, transport or supply disruptions, utility failures).
17. Prohibited uses
You must not use the site or its content for unlawful purposes; to violate laws; to infringe IP rights; to harass or harm others; to send malware or spam; to collect others’ personal data without a lawful basis; or to circumvent security.
18. Suspension and termination
We may suspend or terminate access if you breach these Terms. Obligations that by their nature survive termination will continue (e.g., payment, IP, limitations of liability).
19. Governing law and jurisdiction
These Terms and any non-contractual obligations arising out of them are governed by Dutch law. The courts of Amsterdam, The Netherlands have exclusive jurisdiction, without prejudice to consumer law giving consumers the right to bring claims in their local courts.
